Could the clothes in your gym bag be part of one of the quietest environmental wins in years? For decades, PFAS, the “forever chemicals” that never fully break down, made rain jackets waterproof, leggings sweat-resistant, and swimwear stain-proof, the same chemistry also turned up in school uniforms, tablecloths, and dozens of other everyday items. Now, a year into the strictest state bans the U.S. has seen, independent lab testing shows something rare: the chemistry inside America’s most sweat- and weather-tested clothing is actually changing, not just the marketing around it.
California and New York banned intentionally added PFAS from most everyday apparel starting January 1, 2025, capping total organic fluorine at 100 parts per million. Colorado and Maine passed similar bans effective this January, and Washington added PFAS reporting requirements for extreme-use apparel in November 2025. A rule that started in two states is turning into a de facto national standard.
The clearest evidence that these laws are actually working comes from NRDC, which bought and tested 115 textile products in California and New York in 2025. Among the 46 rainwear, athletic-pant, swimwear, and footwear items in that sample, a category built almost entirely on the promise of holding up to sweat, water, and repeated wear, 38 measured under 10 parts per million, and only two exceeded the state’s new 100 ppm threshold. That’s a striking signal that state bans are reaching all the way into the supply chain, not just the label.
What the Testing Found
NRDC’s broader sample puts those performance-wear numbers in context. The cleanest results were
concentrated in exactly the categories built for water, sweat, and stain resistance:
- Overall, 79% of the 115 products tested under 100 ppm, 70% under 10 ppm, and 60% under 5
ppm - Selected rain jackets, one of the toughest tests for a PFAS-free fabric, ranged from 760 to 83,000 ppm in earlier testing rounds, then fell to just 1.6 to 27 ppm in 2025, a reduction of 97% to 99.99%, though these were different jackets tested in separate rounds rather than a controlled comparison
- Everyday household textiles told a different story: every tablecloth tested still exceeded 100
ppm, along with most pet accessories and reusable diapers, categories the new laws haven’t
fully reached yet
Jaylin, founder of Sodalemon, said the results reflect a shift she’s watched play out from inside the
industry. “For years, performance and safety were treated as a trade-off. You either got a fabric that held up to sweat and weather, or you got one you felt good about wearing next to your skin. That’s no longer true, and the data proves it. The brands still leaning on PFAS aren’t doing it because the alternatives don’t work, but because nobody’s made them stop.”
The Gap Between Labels and Reality
Federal labeling rules cover fiber content, country of origin and care instructions, but not PFAS, and the mismatch is most visible on exactly the claims performance apparel relies on to sell itself: “waterproof,” “stain resistant.” That gap between what’s disclosed and what’s actually inside the fabric shows up clearly in the testing:
- 20 of the 24 products that failed testing carried labels like “waterproof” or “stain resistant”
- Most of the clean products carried the same labels
- A 2025 scorecard of ten children’s fashion brands found an average chemical-safety score of
35.3 out of 100 - Even brands with published restricted-substance lists didn’t apply them across their full product
range
Nowhere is the cost of closing that gap clearer than in performance wear itself. Patagonia says every new style since Spring 2025 ships without intentionally added PFAS, the result of roughly 15 years of reworking its membranes and finishes. Its PFAS-free waterproof jackets need rewashing every 7 to 10 wears to keep performing, compared with about 30 wears for the PFAS-treated version, a small but real tradeoff for a chemical-free supply chain.
Where the Pollution Actually Starts
The stakes extend past the finished garment, back to the specific chemistry that performance apparel depends on. A 2025 Duke University study traced a major PFAS contamination event in North Carolina to a single textile-finishing plant, where wastewater measured roughly 3 million times the EPA’s drinking-water limit for certain PFAS. Regulators had missed it for years because the chemicals showed up as solid nanoparticles, not the dissolved compounds labs typically test for. Researchers matched the nanoparticles to a water- and stain-repellent fabric treatment, the same class of finish that makes rain jackets and athletic wear perform.
Once the plant changed its process, PFAS levels downstream measurably dropped, evidence that fixing the factory, not just the finished product, is where the real cleanup happens for the fabrics people count on to perform. Most U.S. textile mills still aren’t required to monitor PFAS in their wastewater at all, though the EPA has proposed changing that in a 2026 stormwater permit.
A Standard by Default
That kind of ripple rarely stays contained to just five states. A 2025 survey found 78% of business leaders said California’s Proposition 65 had already pushed them to reformulate products, and 63% said that reformulation reached products sold outside California entirely. It comes down to simple economics: retooling a factory line to meet the strictest state’s rules is usually cheaper than running two versions of the same garment, one clean and one not. So a regional law quietly becomes everyone’s law, and performance wear, the category with the most to prove, is where that shift shows up first.
What it can’t undo is the PFAS that’s already out there. Old rain jackets and worn-out uniforms are still sitting in landfills. Sewage sludge carrying decades of fabric-finishing runoff is still being spread across farmland as fertilizer. The EPA’s own 2026 guidance on PFAS disposal admits regulators still aren’t certain whether landfills or incinerators can fully contain these chemicals once a garment is thrown away, only slowing them down.
Getting PFAS out of new clothes, it turns out, may be the easier half of this problem, especially for the performance fabrics leading the shift. Getting it out of everything already buried, burnt or bought years ago, from decades-old apparel still failing today’s tests, is the part nobody has solved yet.
